01 Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

02 The Service

picoask connects to data sources you authorize, generates and tests hypotheses, and returns analysis, statistical assessments, and suggested actions. Outputs are generated by automated models and are provided for informational purposes only.

You are responsible for reviewing outputs before relying on them or sharing them. Picolearn does not guarantee that any analysis, statistical result, or recommendation is accurate, complete, or fit for a particular purpose.

As between you and Picolearn, you own the outputs picoask generates from your data. Because outputs are model-generated, other users may receive similar outputs, and you are responsible for how you use them.

03 Nature of AI outputs

picoask uses generative and statistical AI. Outputs are probabilistic and non-deterministic — they may be inaccurate or incomplete, may state incorrect information with apparent confidence, and may vary between runs for the same question. Outputs, including statistical results and suggested actions, are decision support, not professional, legal, or financial advice. You are responsible for independently verifying outputs before relying on them, and must not use picoask as the sole basis for decisions with legal, financial, medical, or other significant effects.

04 Your data

You retain all rights to the data you connect to the Service (“Customer Data”). You grant Picolearn a limited license to process Customer Data solely to provide, secure, and operate the Service, as described in our Privacy Policy. We do not use Customer Data to train foundation models without your consent.

You represent that you have the necessary rights and permissions to connect and process any Customer Data through the Service, and that doing so does not violate any law or third-party right.

05 Personal & sensitive data

picoask analyzes the data you connect, which may include personal data. You are responsible for the Customer Data you connect or submit — including for having a lawful basis to process it and for honoring the rights of the people it concerns. Do not connect, or type into queries, any sensitive or special-category personal data — for example health, financial-account, government-ID, biometric, or precise-location data — beyond what your analysis genuinely requires and are permitted to process. picoask is not intended as a store for sensitive personal information; submit it only where necessary and lawful for your use of the Service.

06 Acceptable use

You agree not to misuse the Service, including by: reverse-engineering or attempting to extract underlying models; using the Service to build a competing product; uploading unlawful content; attempting to gain unauthorized access; or interfering with the integrity or performance of the Service.

07 Beta & waitlist features

Portions of the Service may be offered as beta, preview, or waitlist features. These are provided “as is”, may change or be discontinued at any time, and may be subject to additional terms. Joining the waitlist does not guarantee access.

08 Fees & billing

Paid plans are billed in advance on a recurring basis and are non-refundable except where required by law. We may change pricing with reasonable prior notice. You are responsible for applicable taxes.

09 Intellectual property

The Service, including its software, models, design, and content (excluding Customer Data), is owned by Picolearn, Inc. and protected by intellectual-property laws. These Terms grant you no rights to our trademarks or branding.

10 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Analytical outputs may contain errors and should not be treated as professional, legal, or financial advice.

11 Limitation of liability

To the maximum extent permitted by law, Picolearn, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our aggregate liability will not exceed the amounts you paid to us in the twelve months preceding the claim.

12 Indemnification

You will indemnify and hold harmless Picolearn, Inc. from any third-party claims, damages, and losses arising out of your Customer Data, your use of the Service, or your violation of these Terms or applicable law.

13 Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately.

14 Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use after changes take effect constitutes acceptance of the revised Terms.

15 Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

16 Miscellaneous

These Terms are the entire agreement between you and Picolearn regarding the Service and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions stay in effect, and our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
